Cornelius van Bynkershoek

Cornelis van Bynkershoek (* May 29, 1673 in Middelburg, † April 16, 1743 in The Hague ) was a jurist of the elegant school in the Netherlands.

Life

Bynkershoek was the son of a sailmaker. After attending grammar school in his native city, he began to study theology at Franeker. In 1691, he moved to Ulrich Huber's recommendation to study law. He received his doctorate in 1694 and settled in The Hague practiced as a lawyer.

In 1704 he became a member, in 1724 President of the Grand Council, the Supreme Court, of Holland, Zeeland and West Friesland.

Teaching

As a civil lawyer is Bynkershoek representatives of the Dutch elegant school. As a member and President of the Supreme Court he has for himself - Bynkershoek did not want to release - recorded his cases, and include details of the consultation and divergent opinions of other judges. Only in 1926 these records were published under the title " Observationes tumultuariae ".

Importance Bynkershoek but also for international law or law of the sea. Unlike Grotius he affirms in his book " De dominio maris dissertatio " the question whether the government can have dominion ( dominium ) over the sea: " The territorial sovereignty ends where the force of arms ends ". Bynkershoek thus developed an effective, philosophical basis for the 3- mile zone.
