Desertion#Absence without leave

Unauthorised absence is not authorized by superiors and not by overriding reasons such as hospitalization forced failure to appear at court subpoenas, military and civil.

Military service

As Unauthorised absence is known in military affairs, the unjustified or unlawful removal from command of the troops with the intention to join the military or military service to escape temporarily. It represents the most common form of an offense against the Military Penal Code ( WStG ) dar.

Community service

Even with community service workers, the unauthorized absence, the most common form of the offense dar.

§ 52 ZDG: Those who leave the civil service without authorization or stays away from him and intentionally or negligently more than three full calendar days absent, up to three years is punishable by imprisonment.

Subpoenas

§ 231 Code of Criminal Procedure: (1) The person convicted in absentia may not be removed from the trial. The Chairman may take the appropriate measures to prevent the removal; also he can keep the accused during a break in the trial in custody.

Since in principle against the absent defendants can not be negotiated, coercive measures are a demonstration, negotiation detention, or a penal order if fine is concerned, possible.
