FIDIC

The FIDIC, the International Federation of Ingénieurs Conseils (French ) or International Federation of Consulting Engineers (English ) is the leading international federation of national associations of consulting engineers in construction. The FIDIC has its office in Geneva, Switzerland.

Objectives

The Association has the statutory purpose represented by national member associations a large number of consulting engineers or engineering companies internationally to support the members with solutions to business practices, to define rules of professional conduct ( code of honor ) and to promote, improve the reputation of the consulting engineer and to promote the commitment of members to sustainable development.

The German member association of FIDIC is the Association of Consulting Engineers (VBI ).

FIDIC contracts

In this capacity, the FIDIC construction contracts have been developed as a standardized model contracts for international construction projects from her. These sample contracts have a similar meaning as internationally in the German market, the VOB / B. They are based on the Anglo-Saxon legal system, however, are designed so that by very comprehensive and detailed contractual arrangements, recourse can be avoided in local government regulations as possible. They are therefore ideal in particular for large-scale construction projects with international stakeholders. The FIDIC contracts are often prescribed or recommended by the World Bank, other multilateral development banks and the EU finance (about 25 to 40 billion USD a year ) when awarding contracts. Especially in Eastern Europe, they are often used even in privately financed investments.

The current contract pattern ( new edition of 1999) are:

  • Conditions of Contract for Construction for Building and Engineering Works Designed by the Employer, "Red Book"
  • Conditions of Contract for Plant and Design - Build for Electrical and Mechanical Plant and for Building and Engineering Works Designed by the Contractor, " Yellow Book "
  • Conditions of Contract for EPC / Turnkey Projects, " Silver Book "
  • Short Form of Contract, " Green Book "

The short names have each developed from the color of the cover. The Association of Consulting Engineers VBI has developed to the essential FIDIC patterns German -language working aids to facilitate the handling of the matter for German companies. This purpose is also a seminar program, which among other things leads to obtaining the qualification for FIDIC Adjudicator.

The contract types differ mainly in the way of the construction project for which they are to be used. Thus, the use of the Red Book is suitable for projects where the client provides the essential planning services, however, the Yellow Book for projects where mainly the contractor has the burden of planning. The Silver Book is ideal for key construction; the Green Book is to be used exclusively when it comes to simpler construction with low order volume and relatively short construction period. In addition, the following model contracts available, such as

  • Client - Consultant Agreement ( White Book )
  • Sub - Consultant Agreement
  • Joint venture agreement.
