Jus soli

Jus soli (also jus soli, Latin ius soli " law of the soil " ) refers to the principle according to which a state gives its citizenship to all children born on its territory. It is therefore also known as birthplace principle (also referred birthplace or territoriality principle) and establishes the legal consequences of an easily verifiable event to. The jus soli is strict, formal and simple in its pure form. This is of no importance what the nationality of the parents.

The principle of descent (jus sanguinis ) is another, usually parallel applicable principle of citizenship acquisition and tied to the citizenship of their parents.

Germany

Since the introduction of citizenship laws was in Germany ( Prussia 1842) jus sanguinis as the dominant purchase facts. Since the Empire and Nationality Act 1913 was in the German Reich on the one hand to jus sanguinis, on the other hand could be naturalized foreigners on request (§ § 8-16 RuStAG ). With the national reform in 2000 was the so-called " option model " an additional jus soli introduced for second -generation immigrants, in which there is a dual citizenship until the age of majority and the person must then decide usually up to 23 years for citizenship ( § 4 paragraph 3 and § 29 Act).
