Mental health court

The guardianship court is in Germany since the entry into force of the Act on the reform of the procedure in family matters and in matters of voluntary jurisdiction appointed for the care and accommodation affairs age of full court. Previously it was called guardianship court.

The FamFG has replaced as a complete recodification the previous FGG and the Book 6 of the Civil Procedure Code as of September 1, 2009. This figure includes also a reallocation of jurisdiction. In contrast to the guardianship court responsibilities for matters of minors began focusing the Family Court.

Before 1 September 2009, the Guardianship Court was bundled responsible for the legal support of full age, an accommodation with all applicable local law on the detention of the mentally ill ( PsychKG ) for guardianship and foster care for minors and for the adoption procedure.

The guardianship court in Germany is a division of the district court. There, judges decide ( as a single judge ) or judicial officer. The Rechtspflegergesetz regulates, is responsible for which matters the judicial officer, in contrast to the judge. A special feature is in the Württemberg part of Baden -Württemberg: the function of the Court of care borne by the competent notary in accordance with § 37 of the Provincial Act of Baden-Württemberg on the voluntary jurisdiction.
