Regulation (European Union)

A Regulation of the European Union (English short form of regulation " Regulation (EU) " ) is a legal act of the European Union with general validity and immediate effectiveness in the Member States. The Regulations are part of the Union's secondary legislation.

Legislative procedure

Regulations are adopted according to the theme of the Regulation as a result of the measures provided for in the Treaties. A distinction is made between legislative acts, implementing regulations of the Commission and delegated regulations.

Regulations, which are legislative acts shall be adopted as a rule on a proposal from the European Commission, the Council of the European Union and the European Parliament in accordance with the ordinary legislative procedure together. In certain cases, however, special legislative procedures are provided.

Addressees

Regulations may apply to the European Union itself, to the Member States or to the citizens of all Member States. If the control only selected Member States or their citizens concern, it is adopted as a resolution ( directly binding ) or policy (to be implemented by national law ).

Demarcation from other EU legal instruments

According to Article 288, paragraph 2 of the Treaty on the Functioning of the European Union, Regulation those acts which have general application, are binding in its entirety and directly applicable in all Member States. You need to be transposed by the Member States into national law ( " direct effect "). Modifications to the regulations prescribed by the individual Member States are in principle not possible ( "Implementation ban "). However, the regulations contain individual items that expressly require or allow adjustments to national law.

Due to the direct effect, the regulations differ from the guidelines. Directives are not directly applicable in a Member State, but may be directly applicable under certain conditions.

History

Before the Treaty of Lisbon regulations have been adopted only by the European Communities under the first pillar. Even if was often spoken of " EU Regulations ", this wording was not correct, since these regulations ( and also the guidelines ) of one of the European Communities and have not been adopted by the European Union. The German -language title of this previous regulations so each starts with " Regulation ( EC) " (or a reference to the respective community). For the adopted since the Treaty of Lisbon Regulations of the title starts with " Regulation (EU )" or - if they have been adopted by the European Atomic Energy Community - " Regulation ( EURATOM) ".

Designation

Regulations which have been adopted until November 30, 2009, to take the title " Regulation ( EC) ... " and regulations adopted by 1 November 1993 ( the European Community Regulation ), the title " Regulation ( EEC) ... " ( Regulation the European Economic Community ), although they now are considered regulations of the European Union.

Publication

Regulations shall be published in the Official Journal of the European Union. They occur at a specified date in the relevant Regulation or on the twentieth day following its publication.

Remedies for violations

If a member state against an EU regulation the Commission is under Article 258 TFEU or other Member States under Article 259 TFEU, the possibility of an action before the European Court of Justice in the form of infringement proceedings open.
