Sabinian school

The law schools of Prokulianer and Sabinianer certain Roman law in the first two centuries after Christ, and therefore the peak of the Roman legal culture.

Interaction and representatives

The School of Prokulianer tried legal cases with logic and innovation to solve, while the Sabinianer to traditional and pragmatic solutions tended. Marcus Antistius Labeo, the most probable founder of this school, follow the important Roman jurist Nerva, Proculus (after the Prokulianer are named ), Pegasus, Neraz and Celsus. The Sabinianern with their forefathers Ateius Capito and Masurius Sabinus had later Cassius, Javolen and Julian.

Principles of both law schools

Prokulianer:

- Restrictive interpretation of all texts.

- Phrases and words should learn a consistent interpretation in all cases.

- Unwritten law was considered as a continuous logical system.

- They stayed with the rules to be analyzed on the underlying principles.

Sabinianer:

- Tried to justify their advice with references to the outdated practice and the authority of earlier jurists.

- They tried to just decisions in individual cases, even if it came at the expense of logic and rationality.
