Social money in accordance with § 19 Section 1 Sentence 2 SGB II in Germany is a welfare benefit under the basic provision for jobseekers for needy persons who are unable to work - and therefore are not entitled to unemployment benefit II -, but with a working person in a community of need live within the meaning of § 7 paragraph 3 Book II, which can even claim on the merits ALG II.
The granting of social assistance by the competent authority of the ALG II Job Center instead of social assistance by the social welfare office to avoid that different authorities are responsible for the individual members of a community of need.
No social money but basic security in old age and disability in accordance with § 41 SGB XII get those who fully incapacitated or reaches the age of eligibility.
Beneficiaries
Social cash received needy persons
- Are not able to work because they can not work at least three hours a day under the usual conditions in the labor market, and
- With an employable persons in need who can claim even on the merits benefits under SGB II, in a community of need within the meaning of § 7 paragraph 3 SGB II live, and
- Are not entitled to basic security in old age and disability in accordance with § 41 SGB XII.
The coming thus for the social allowance in consideration of persons includes the following groups of people:
- Children under the age of 15 years, who live in a community of need,
- Permanently incapacitated minors in a community of need until the age of 18 years or
- Age beneficiaries in a community of need that are neither fully incapacitated are yet have reached the normal retirement age.
Also, do not employable, minor children of trainees carrying out one after the federal financial aid or under § § 51, 57, 58 SGB III ( training aid ) to an eligible training and therefore SGB II themselves according to § 7 paragraph 5 are not entitled to unemployment benefit II, have claim to the social benefit.
Scope of the welfare money
The social benefit includes the power to cover the following requirements:
- The control requirements for adults, young adults, adolescents or children according to § § 20, 23 SGB II,
- The additional requirements according to § § 21, 23 SGB II and
- The needs for housing and heating according to § § 22 et seq SGB II
History
The social benefit is a benefit for need of assistance, which was created in January 2005 from the changes in social legislation after the Hartz concept.
According to the Hartz Commission's ideas was provided that the social benefit replace the present social assistance and should be managed by the social services, so by the local authorities. The social Amter Solten social assistance beneficiaries care at a service center under the roof of a job center.
This far-reaching organizational concept was ultimately not implemented. The idea of a single point of contact ( "one- face-to- the-customer " ) was taken into account that the non- employable persons in need who live with ALG II recipients in a community of need, social assistance by the social welfare office, but social benefit of the same place get Solten which also provides the ALG II. For all other non- labor force remained in the social assistance.
The measures described as merging the two benefits unemployment assistance and social assistance thus do not affect all previous welfare recipients. From the two merged services have therefore become three: ALG II, social allowance and ( continue to) social assistance. The social benefit under SGB II, unlike social assistance, paid not by the municipalities, but the federal government.
Asset exemption amounts
There are the same allowances as for employable needy (→ ALG II allowances). This is a significant difference from the basic security in old age and disability ( allowance 2600 € → asset credit).
Recognition of income
Income would be credited for employable needy (→ income deduction ) as the unemployment benefit II. The income mainly includes child benefit, but also child support, and most other social benefits.
