Suspect

A suspect in the broader legal sense is a person who is suspected of a crime, although this legal term is not used by the legislator in Germany.

Suspect in the strict sense

In the Swiss Military Criminal Procedure is to be treated as a suspect, a person against whom a preliminary inquiry (or troops internal disciplinary proceedings ) is passed. In contrast, the accused is in the context of a preliminary investigation or the - already formally - defendants.

The cantons can rewrite the term of the suspect nor independently pending the unified Code of Criminal Procedure.

Position of the suspect

The position of the suspect should in principle correspond to that of the accused, so that his later position is not compromised. So the suspects are the same teachings vorzuhalten as the accused (such as in the U.S. Miranda warning).

However, the applicable procedural law may provide for a different treatment of suspects and accused: So the remand in the Swiss military criminal law can only be ordered for accused persons, but not for merely suspects ( see Article 56 MSTP ).
