Title (property)

A title (Latin titulus ) referred to in the law a legal right that is based not only in the material sense, and still exists, but has just been verified and perpetuated from one authority to be asserted with full recognition may, without may be questioned.

The titling ensures through formal rigor and uniformity a fluid legal and business traffic. This calls for marketability usually a document.

International is known in legal relations on the title and the right holder: about French = titulaire owners. In Germany this is not common.

Examples of items are:

  • The passport is standardized in terms of recorded features and legal relationships between sovereign in each traffic
  • Residence permits in line with the Schengen standards, which are recognized in the entire scope of the agreement of administrative authorities readily
  • Purchase contract, donation, lease, contract, partnership agreement or other contract transactions derived from the title of the law of obligations
  • Checks, bills, bonds and other securities, in terms of through them independently substantiated claim basis and at the following applies in principle, according to Roman tradition: Order Paper - the right on the paper follows the law of the paper: the primacy of the law of obligations
  • Bearer - the right of the paper follows the right on the paper: the primacy of the law of property
  • Final final judgments with enforcement or provisionally enforceable declared final judgments of courts, comparisons to court, notary comparisons ( of deeds), enforcement orders, etc. each with regard to the enforcement of legally enforceable power content ( § § 724, 794 Code of Civil Procedure ( ZPO) )
  • Administrative decisions ( decisions, inter alia ) the extent of its enforcement enabled performance clauses

No enforceable are:

  • Negotiable mortgage deeds and mortgage letters - for them we require customary titling in the cognitive process, to enforce the claim
  • Passbooks and other identity papers
  • Final final judgments of courts without enforcement ( § 724 ZPO)
