Vehicle registration certificate

The registration certificate is an official certificate of registration of vehicles on road traffic. Content of the registration certificate is:

  • Individualisation of the vehicle, usually on the basis of contracts awarded by the manufacturers vehicle identification number ( colloquially VIN )
  • The allocation of a motor vehicle registration plate to a particular person ( this is usually the owner, however, the registration certificate in Germany no proof of ownership is, in other EC countries this may be different)
  • That the vehicle meets the technical licensing requirements (type approval ) of an EU state.

The registered person in the registration certificate is only the owner of the vehicle. This can - but need not - the owner or owners to be identical. Therefore, it is made clear on the registration certificate Part II, that the holder of the registration certificate is not recognized as the owner of the vehicle. The registration certificate was introduced by 2005 in the countries of the European Union.

This introduction should unify the different national authorization procedures and improve data protection. For example, contained the former German vehicle registration name and residence of up to six Vorhaltern and the times of their governorships.

In fact, the registration certificates soft between states - sometimes even within that - to some extent from each other. The data is not protected to the same extent in Europe.

Germany

For motor vehicle registrations and re-registration, the registration certificate part I replaced since October 1, 2005 in Germany the car registration, the registration certificate Part II replaces the vehicle title.

Benefits

The most important advantages of the new document you can see the higher security against counterfeiting, the EU-wide readability and standardization of data fields. In addition, the registration certificate Part I contains more information than the output end of September 2005 registration document.

Disadvantages

Criticism is mainly that in Part II of the previous maximum and the current owner of the vehicle can be listed (as opposed to six in the German vehicle registration document until the end of September 2005). Consequence is a difficult valuation of used vehicles. Another holder list, however, the European Union rejects for privacy reasons. However, the point B (1) shows the number of the previous owner of the vehicle.

Furthermore, it is criticized that only a permissible tire size is not specified. In the former vehicle registration several alternatively usable sizes were usually given.

Exchange

An obligation to exchange does not exist: you have the old registration papers not so new ones. However, it may not be new old papers give ( for example, an old vehicle registration and a new certificate part I), no vehicle.

Be exchanged Paying the old papers when the admissions office would have to change for the first time the old papers, for example in order or application or retrofitting of particulate filters. The vehicle registration certificate is destroyed, it replaces the registration certificate part I, the vehicle registration is canceled, replaced him the certificate part II

Use the old names

For the registration certificates also the old designations vehicle registration and vehicle registration can be used as the old names are still on the new forms small printed directly under the new names.

Registration certificate part I ( vehicle registration )

The registration certificate part I is regulated in § 11 FZV, which refers to the pattern of 5 FZV. Problems are sometimes the transfer of old information into the new papers. Thus, in Germany in Part I, paragraph 15 ( tires), for example, only registered a tire size. The documentation of any alternate registrations or exemptions of tires bonds and all other registrable technical changes to the series state is in box 22 ( remarks and exceptions) with appropriate referencing done ( in the case of tires bonds, for example, to paragraph 15 ), however, this is a regional not handled uniformly.

Basically, the new Section 22 of the Registration Certificate Part I for the acquisition of the entries in the "Remarks" box of the former registration certificate serves.

If the space there not, a supplement is issued, sometimes attached. Some admissions officers fill out this field with a form completion, which transferred the references to the number of old car bill automatically on the digits of the registration certificate part I, so that the referencing is correct again.

It is recommended to be sure to allow for issuance of new documents itemizing devalued the old vehicle registration document and store it carefully, can thus be investigated at a later stage, as the original entries have looked like. It is advisable in any case to check the correct transmission of all information at the time the new papers carefully and - if necessary - to complain yet directly in the Admissions Office.

The police is entitled during an inspection to inspect the registration certificate I, it is according to § 11 paragraph 5 when driving a motor vehicle shall be kept permanently FZV. Those who do not submit the registration certificate Part I at a police control, commits accordance with § 48 No. 5 FZV an offense and can be punished with a caution money of ten euros.

Information of each field

Registration certificate Part II ( vehicle registration document )

The registration certificate Part II is regulated in § 12 FZV, which refers in paragraph 2 on the pattern of 7 FZV. This consists in Germany from a single-sided document on fälschungsgesichertem special paper in the format 21 x 30.48 cm ( formatted 21 × 29.7 cm). The back side is provided with a solid under reduced pressure.

The VIEWERS a vehicle ( colloquially often incorrectly referred to as owner), with the exception of the last Vorhalters (as opposed to - until September 30, 2005 issued - vehicle registration document ) not particularly comprehensible. Instead, it is only the first day of admission and the number of registered VIEWERS. From the third owner of the vehicle for each additional second subsequent holder (ie the fifth, seventh, etc.) issued a new document in the approval.

Property protection

The officially registered personal denote the natural or legal person who is authorized to dispose of the vehicle.

In the Federal Republic of Germany, the registration certificate Part II no proof of ownership dar. In C.4c box is marked: " The holder of the registration certificate is not recognized as the owner of the vehicle. " In other EC countries this can be otherwise.

This permission relates only available on the public responsibility for the vehicle. A transfer of ownership of the vehicle is therefore also without a transfer of the registration certificate Part II ( vehicle registration document ) is possible, because it is not a tradition of paper. According to settled case law, the registration certificate part II but has an indicator function with respect to the civil property. Thus, the good faith purchase of a car is not possible if the certificate part II will not be transferred. If it turns out that the seller was not entitled to re-transfer the vehicle, the acquirer has not acquired title to the vehicle. The indicator function is so much in practice that a commonly held view prevails, the registration certificate Part II ( vehicle registration document ) embodies the title to the vehicle or prove it. However, it does not have this civil function.

An exception to vehicles up to a maximum of 11 kW. For them, only the registration certificate Part I exhibited at the Admissions Office.

Without submission of the registration certificate part II, the approval body may allocate no ( new ) registration number or make a change holder. For reasons of public policy is to prevent that a stolen or illegally erlangtes vehicle is brought in the traffic. In fact, a possible backup owner is protected at the same time ( such as the bank financing the purchase of the vehicle on credit ). It should be noted in the financing of motor vehicles by transferring ownership, the importance of the registration certificate part II

The registration certificate is Part II in the vehicle, that fact will be considered as gross negligence. Theft insurance reject it therefore usually starting to make a replacement set. The Higher Regional Court of Cologne ruled, however, that the insurance company is still required to pay. An exception is made only if it can prove that the vehicle was stolen just because of the papers therein.

Form theft

Approval bodies were already victims of burglaries where blank forms of registration certificates in numbers were stolen from several hundreds. These papers are already provided with a document serial number. They are issued by vehicle thieves on the stolen vehicles. The Federal Ministry of Transport referred to the Privacy Policy and prevented the publication of the serial numbers of the stolen forms. Car buyers are therefore at the mercy of fraud, since they can not verify the serial number yet, as is customary in the U.S., the vehicle identification number as stolen on the Internet. The buyer of a stolen car then threatens the surprise on the approval body. There, the vehicle is detected and seized as stolen property. Since concealers fill the papers, they can also add a fake identity in the papers as the owner and are therefore no longer available.

Austria

The registration certificates Part I and Part II are official documents to clarify the authority to operate a motor vehicle on public roads in Austria, they are issued directly to the license plate.

In Austria, the registration certificate by the registration certificate Part I and Part II has been replaced since 1999.

The registration certificate Part II is kept in the normal case with the type certificate by the owner, usually at home or at the financing bank.

The registration certificate is issued contrary to the certificates of approval in the approval bodies, which are usually located at branch offices of insurance companies. These are also responsible for handing out the license plates in the series. Also, the certificates shall be issued in case of loss there within a short time copies.

Since January 2011, the registration certificate is optionally also issued a check card with chip. To ensure that all data are no longer available as a human-readable text on the card, but only on the chip can be read out. The second part of the certificate is issued as before. After Slovakia Austria is the second country in Europe in which the recommendation of the European Union has been implemented.
