Actio popularis

As a popular action is called in law a lawsuit brought by someone who is not directly affected. In Germany the popular action is permitted only in exceptional cases (see legal standing than admissibility ). One exception is in the Constitution of the Free State of Bavaria laid down in Article 98, sentence 4 BV way for anyone to appeal civil suit at the Bavarian Constitutional Court. In this case, each Bavarian law, regulation or statute be submitted to the Bavarian Constitutional Court, claiming a guaranteed in the state constitution of fundamental rights being violated by the law in an unconstitutional manner. The Constitutional Court shall review the law then click accordance with the complete Bavarian constitutional law and, where necessary, determine its constitutionality.
