Agricultural road

As a service roads, field, forest or water designated service roads in Germany. A ruling by the Federal High Court of November 18, 1975 is referred to as field, forest, meadow, vineyard and other farm roads regardless of the Wegbefestigung if they

  • Serve predominantly agricultural or forestry purposes
  • Have no more than local significance.

Classification

The classification of industrial routes is based on the "Guidelines for rural road construction " (short RLW ) in the following:

First connection paths

  • Connection paths with greater importance for traffic
  • Connection paths with lower traffic importance

2 lanes

  • Rural roads ( fixed )
  • Greenways (unsurfaced )

3 forest paths

  • Driveways
  • Skid tracks

4 Other rural roads

The forestry paths ( also forest roads ) can be in turn divided into the following types of routes:

  • Main routes
  • Feeder routes
  • Skid tracks

Structural Engineering

Depending on the strength of the expected utilization of the paths can be executed in one or two-lane. Are rarely expect encounters or overhaul the system of passing places is sufficient. The paths have a width between 5.0 m ( two-lane ) and 3.0 m ( einstreifig ). The cross slope of the roadway should be between 3.0% (asphalted) and 7.0 % ( without asphalt, eg with water-bound ceiling) are to ensure sufficient drainage.

To keep the surface sealing and the costs low, only gauge railways (lane roads) are often applied. In this case, only the rolling track is fixed, the gap remains unpaved. Depending on the building material this way are also called asphalt or concrete lane track.

Terms of Use

Right of way

On a farm road, the general principle law is repealed before left (see right of way ) when the field or forest road leads to a (different ) Street. The current coming from the dirt road driver always has to respect the right of way, without the need for a right of way signs ( § 8 paragraph 1 item. 2 Highway Code ).

From the right comes from a particularly poor visibility may byway supposedly entitled to priority as a waiting payer has hineinzutasten in the main street. If they do not, they contribute at least partially to blame for relevant accidents ( Rostock Higher Regional Court of 23 February 2007 8 U 40 / 06, complicity there 40%).

Crossings

At crossings of rural roads, it is not necessary according to § 11 EBO to set up a St. Andrew's cross ( 201 characters Highway Code ) to warn of road traffic. Rail has the right of way.

Limitation of use

In Baden- Württemberg the dirt roads are dedicated to public use, but only as a limited public way for the management of adjacent agricultural and forestry land. It can be viewed as a misdemeanor if a dirt road is traveled without a special use permit. A separate locked by the traffic sign is not required because the roads are already blocked due to their dedication as a public limited way.

In North Rhine -Westphalia rural roads are not dedicated as public roads or paths, but remain private roads, even if they are temporarily enters the property of the city or municipality. It is believed that economic way originally (some at the partitions of the common areas at the beginning of the 19th century ) have arisen from the ownership of the surrounding land and still reserved for their use.

Ensuring public safety

According to a judgment of the OLG Koblenz dated 7 April 2003 ( Case No. 12 U 1829/ 01) the requirements of the duty to maintain safety for a dirt road are significantly lower than for other roads. For roads, the owner must take any special precautions against the typical dangers in such terrain. Way the users (and especially " secondary users " as cyclists, walkers and horse riders ) must reckon with bumps, potholes, stones and tree roots on the trails. Warning signs and danger signs must not be placed in general. In cases of damage due to the risks typical of the way the owner or construction agencies shall not be liable.

Impact Regulation

Economic Infrastructures can lead to ecological drawbacks, mainly to barriers effects at the expense of small animals. He fulfilled therefore generally held to constitute an intervention in nature and landscape. In places, states have made available to economic road construction under nature conservation law without authorization, eg Hesse in the development of service roads on the same route and wassergebundenem structure ( cf. § 13 Section 3 No. 10 Hessian Nature Conservation Act v. 12/2006). The principle of operation minimization, which is not canceled, depending on the type of permit freedom satisfy eg Track lanes with a structurally stable central vegetation strips on the ecological barriers reduction.
