[ GNFS 5] The inaugural meeting was held in Thun on 15 February 2008. [ GNFS 6] The GNFS was responsible for all the construction of the stadium related tasks (liaising with investors and planners, the building permit, etc.). They also created the valid start operating concept and planned the construction of the Operating Company Arena Thun AG. [ GNFS 4]

Arena Thun AG

The Arena Thun AG ( ATAG ), which was established on 25 March 2010 under the name Stadion Thun AG, is a wholly owned subsidiary of the cooperative Arena Thun. The marketing of Stockhornstrasse Arena and, initially, the FC Thun was one of the main tasks of ATAG. She was responsible at the beginning for the entire stadium operations and consequently also for the implementation of the football matches of clubs. [ Md 7] Increasing tension between the Arena Thun AG and FC Thun AG meant that you look at July 25, 2012 on, it was agreed that to mix the Board of Directors of the two independent public companies. There should be two board members are designated to hold a seat in both the FC Thun AG as well as in the Arena Thun AG and one president who only projects his company and the casting vote falls. [ Md 8] However, this concept was not successful. Beginning in March 2013, it was announced that the arena Thun AG transfers all related to the schedule of the football club duties from 1 July 2013, the FC Thun AG, including the marketing and ticketing. [ Md 9] Since July 2013, the arena Thun AG therefore only responsible for the organization and implementation of a variety of other events.

FC Thun AG

The Football Club Thun has no shares in the Stock Horn Arena. He has only a right of use. From opening of the stadium, up to and including the end of 2012/13 season the club had also no duties in connection with the implementation of the home games. Since the FCT thus could also generate no revenue through ticketing, he was paid by the Arena Thun AG with annual re -defined amount, which was based on the gross profit of the Arena dependent. The less money the arena took so overall, the less stood for the sports. For this reason, the FC Thun AG was eligible to play for the Super League in danger and urged at the arena on adjustments, which took effect on 1 July 2013. Since then, the Football Club is again responsible for the marketing and ticketing, the Arena Thun AG must however pay new rent. [ Md 9]

Prehistory

Carlos Reinhard, the first Chairman of the Cooperative Arena Thun, was a former director of FC Thun AG (formerly FC Thun operation AG). He had this mandate from May 2007 to June 2008 holds, and thus had of February 2008 ( establishing cooperative) to June 2008 ( elections FC Thun AG) a dual mandate. During this time, both parties signed an agreement under which the cooperative FC Thun third of the share capital of 10,000 shares ( ie 3'334 ) for CHF 500,000 could buy. In a later patch supplementary treaty was stipulated that the shares are not immediately sold, since the cooperative as a potential buyer at the time could not be sure whether the FC Thun AG the then impending bankruptcy would be able to prevent. [ Md 10]

The elected in May 2008, the Board of Directors (BoD ) of the FC Thun AG wanted to achieve that investors, the cooperative and the FC Thun AG represent three parity forces as possible, trying at the 2008 Annual General Meeting, to counteract a rise of the cooperative by a voting power limit to be introduced should. In future General Assemblies would otherwise have been easy for the cooperative to reject amendments to the Statutes of the FC Thun AG, for the VR would have a two-thirds majority needed. In these efforts, the Board of Directors saw the investors, as a representative of the cooperative, a breach of contract. This had in fact agreed to let the FC Thun for three years to get a loan of one million francs per season. Only thanks to this total was in early 2008 the matches of the first team to be maintained. [ Md 10] In return for this financial aid, the investors secured from current and future players rights and insisted on other decisions to be able to take an effect. [ Md 11] At the meeting on October 28, 2008 approved the shareholders of FC Thun AG finally a negotiated by the parties involved compromise: buy the cooperative football stadium Thun -South was thus under the contract 30 percent of the shares of FC Thun AG [ md 12]. Nearly a year later, on 22 October 2009, planning permission for the stadium in Thun -South was present and became, as announced by the investors who converted the loan into a donation. [ md 10]

Name

During construction, the new stadium of FC Thun was based on the proximity to the motorway exit called " football stadium Thun Süd ". Even before the completion of the stadium trying to find a title sponsor of the arena manager. However, the amount of the required sum and the desire for a long-term commitment ( at least 8-10 years) deterred potential buyers. Since the search was unsuccessful, the stadium was given the neutral name " Arena Thun ". [ Md 16]

Noise dispute

FC Thun, as not directly involved party, an audience restriction was imposed because of the dispute. The dispute has now been settled, lifted the restriction.

In Switzerland, the German sports facilities - Noise Ordinance is applied, be counted in the 50 decibels allowed (as compared with an average lawn mower: 70 decibels ). Measurements of the specialist unit noise acoustic / laser technology, the Canton police revealed that the value at 6000 spectators were just observed. With sold-out ranks the value will, however, exceeded by about two decibels. Because the then Thun government governor had issued the stadium operators at the opening of the arena only a provisional operating license - including the requirement to implement additional noise abatement measures, it is too loud - was supported by the HRS, to close the gap between the stadium floor and grandstand roof. This prompted the company had not followed, on the grounds that the majority of the noise on the roof dodge. [ Md 18]

Also relevant is the average attendance of FC Thun in the assessment of noise exposure. This was in season 2010/11 at 4792 persons, in the following season in 6100 and 2012/13 in 5328, which shows that the noise level was exceeded only in exceptional cases. Specifically: the only games where the viewer section of the FC Thun exceeds the mark of 6,000 spectators each distinctive, and is expected to nearly sold-out stadium and thus exceeded the noise level, the twice per season discharged derbies against the Berne Young Boys (YB ). So the stadium was sold out in the direct meeting of 10 December 2011 and at the game from May 13, 2012 attended at least 9118 spectators the arena.

After the FC Thun had already played two home games in the 2012/13 season, without incorporating protested against the lack of noise barriers, and the home game against Young Boys decency (27 September 2012), erwirkten some Thun a super temporary injunction ( issued by the construction, transport and energy management ) because of no more than 6,000 tickets were to be sold for the Bernese Derby. [ md 19] [ md 20] because the Thun government governor there under left in the episode, disposed of him lifting the audience restriction and a project change relative to publish noise abatement measures, the judiciary, community and Churches ( JGK ) handed the dossier in March 2013 the government governorship Bern -Mittelland after the complaining residents had made a rejection desire. [ md 21] For the play-off game the Europa League against Partizan Belgrade on 29 August 2013, the restriction was lifted, as for the three home games of the group stage. [ md 22] on December 13, 2013 was finally able to reach an agreement in the dispute noise can be achieved. [ 23 md ]
