Brazilian nationality law

Brazilian citizenship is acquired by the Federal Constitution of Brazil, both by the principle place of birth (jus soli) and after the principle of descent (jus sanguinis ). For this purpose, the Constitution distinguishes between " native " and " naturalized " Brazilians.

First Brazilian Constitution of 1988, Article 12: There are Brazilians:

  • A) born in Brazil, (jus soli), unless the parents are in a foreign government service (eg diplomats );
  • B) the foreign-born if the parents are in the Brazilian service (ius sanguinis );
  • C ) ( 2 constitutional amendment on June 7, 1994), foreign-born children of a Brazilian parent ( father or mother), if they take up residence in the Federative Republic of Brazil and apply at any time the confirmation of the existence of the Brazilian nationality by birth.

The Constitution also provides for several possibilities of naturalization.
