Council of State of Vaud

The Council of State ( Conseil d' État French ) is the government of the canton of Vaud. It consists of seven members ( conseiller d' État ), which each run their own department.

Since the revision of the cantonal constitution in 2003, the State Council is elected every five years by the people. The members of the State Council shall appoint from among its members for the entire length of the Legislature a person President of the Government ( Président du Conseil d' État ). No other Canton provides for a longer term. Before the constitutional amendment, a new president was on a rotating basis each year determined as is the case today in most other cantons.

History

The Small Council (1803-1814)

Developed in 1801, the draft constitution was first mentioned in the Petit Conseil. The draft stipulated that the little council, composed of ten members of the Great Council should be ordered. A term of office was to last nine years, there were strict selection criteria. A Kleinrat had to be at least 30 years old, already holding a Public Office and also earn at least 3,000 Swiss francs.

Finally, with the Act of Mediation on February 19, 1803 saw the introduction of a somewhat modified scheme. Nine members of the Grand Council were elected now for six years. However occurred every two years renewal elections in which a third ( three people) were replaced. The president moved every month to be a member.

As of April 22, 1803 three departments were introduced, which were each conducted by a Board with three small boards. Every four months, had to leave the department and take a seat on for another a member. There was the département de législation ( Department of Justice), the département de l' intérieur ( Department of Home Affairs ) and the département des finances ( Department of Finance ).

The département de législation was renamed on June 7, 1810 in the département de justice et police (Justice and Police ).

The first Council of State was occupied with the following personalities ( including spare people):

The Council of State (1814-1831)

With the corrected Constitution dated 4 August 1814 of the Small Council was reorganized. The number of members was increased to thirteen, but all had previously taken a seat on the Grand Council. They were elected for twelve years, a part was replaced every four years and they were re-elected. The title of the Conseil d'État (Council of State ) has been introduced.

The Grand Council of the elected government councils elected two presidents, which then the title Landammann contributed. They were elected for four years and took over the Bureau alternately for a year. She also presided over the Grand Council and were always re-elected.

New the department was added militaire ( Military Department ), which is also the reason for the increase in membership. The division with the commission and the procedures remained the same as before.

The Council of State (1831-1845)

The constitutional amendments of March 26, 1830 did not provide for modifications. Almost a year later on 25 May 1831 next revision of the Constitution. The State Council has now been reduced to nine members, which, however, still had to be in the parliament before. They were elected for six years and were also re-elected. Every year, the State Council appointed a president, which could no longer be re-elected immediately.

The department name remained all the same, but were out from now on only two instead of three members. Each Council had to stay for three years in the same department and every 18 months there was a new member to it.

The Council of State (1845-1861)

On February 14, 1845, the entire State resigned closed. On the same day the assembled inhabitants chose on the Place de Mont Benon in Lausanne a new provisional government, consisting of nine members.

The amended Constitution of August 10, 1845 9 members were elected for four years from the Grand Council in the State Council, were re-elected and has partly been replaced.

The Council of State (1861-1885)

With the revision of the Constitution of 15 December 1861 the number of state councils was reduced from nine to seven. Now also people were selected which had no seat on the Grand Council. Every four years, were held re- elections. The president was newly diagnosed each year and was not directly re-elected. The organization of the departments has also changed. The number was increased from four to seven and each member was thus head of a department.

The State Council (since 1885)

March 1, 1885, the constitution was changed again. The Panel further consisted of seven councils, but which were now no longer have a seat on the Grand Council. If a Grand Council was elected the State Council, he had to resign from the former office. The Council of State is determined by the Grand Council for four years and is eligible for reappointment. When a vacancy immediately a new appointment is set.

The Law of 5 September 1917, newly prescribed that the United Council is elected directly by the people, but remains eligible for reappointment. With a staff mutation, a new Council is determined on the first Sunday in March. The first popular election was held on 3 March 1918. It was required that each voting person not more than two members from their community, were in the larger cities, choose from their district. At the election of the President, as well as the departmental distribution, there were no changes.
