Election Commission of Malaysia

The Election Commission of Malaysia ( Suruhanjaya Mal. Pilihan Raya Malaysia ( SPR ), dtsch Election Commission of Malaysia) is provided for by Article 114 of the Malaysian Constitution organization that is responsible for the organization and holding of free and democratic elections in Malaysia.

History

The Election Commission of Malaysia was created on September 4, 1957 on the basis of Article 114 of the Malaysian Constitution.

The electoral law of 1958 ( Elections Act 1958), in turn, defined the duties of the Electoral Commission and determines how these tasks are performed in accordance with the Constitution.

At its founding, was the electoral commission only from the chairman Datuk Mustafa Hassan Albakri and two members, Lee Ewe Boon and Ditt Singh. As the first secretary H. Cassidy was appointed.

The current chairman of the Electoral Commission since December 31, 2008, Tan Sri Abdul Aziz Mohd Yusof.

Tasks of the Electoral Commission

Are laid down by the electoral law duties of the Electoral Commission

  • Review and possible new positing of boundaries for electoral districts and constituencies,
  • Voter registration and verification of voters list and
  • Implementation of national elections and in vacant seats in Parliament or the state legislatures to carry out the election.

Appointment of members

The Electoral Commission is inserted through the Malaysian ruler after consultation with the ruler conference. The Commission consists of a chairman, his deputy and three other members. For the appointment of the electoral commission, the Constitution gives the Malaysian King a special responsibility on the way, which is to ensure that the election commission enjoys the confidence of the public.

Two other members from the states of Sabah and Sarawak increase the number of commissioners to seven.

Personal qualifications

The Constitution has specific requirements regarding the personal qualifications of the elected members; so not rehabilitated bankruptcy debtor, Member of Parliament and MPs from the state parliaments are excluded from this office, nor may the members of a paid secondary employment outside their office investigate.

For the Chairman of the Electoral Commission further restrictions apply, so this may not even be active on boards, organizations, companies or industry, even still unpaid on the basis of a consideration. A voluntary non-remunerated activity in organizations devoted to the charitable or social matters is permitted to him.

Once appointed, members of the Electoral Commission shall remain in office until age 65. Similar to the judges of the Supreme Court, it should not be dismissed, except they no longer meet the personal qualifications already mentioned.

For the payment of the salaries of the Electoral Commission and a Remuneration Parliament has jurisdiction.

Administrative tasks

In performing its duties, the Election Commission may appoint officials who act on their behalf. The administrative activities of the Electoral Commission are carried out by a Secretariat, which is headed by an Executive Director. This function is filled by Datuk Kamaruddin Mohamed Baria.
