The exclusive legislation in Germany stipulates that only the federal government has the right to regulate some areas by legal norms ( laws ). Only if countries are mandated in a Federal law to regulate this may subregions itself according to the provisions of this Federal Law. The legal basis is Articles 71 and 73 of the Basic Law.

To the right areas of exclusive legislation include:

  • All foreign, de facto supranational affairs
  • Rules of nationality
  • Currency and monetary issues
  • Unity of the customs and trade area
  • Cooperation of the federal and state governments in the Criminal Investigation
  • Defense, including protection of the civilian population
  • Copyright

Newly added by the federalism reform, the following areas:

  • Arms and Explosives Act
  • Nuclear energy law
  • Reporting
  • Notary beings

Contrast, there are also areas that are exclusively national matter, eg:

  • Burial law
  • Education policy
  • Restaurant law
  • Municipal Law
  • Police system ( with the exception of the Federal )
  • Road construction (except motorways )
