French Civil Service

Fonctionnaire called in French administrative law, a person who is permanently incorporated into the management (CE dated 4 June 1954) and is appointed by administrative act.

Demarcation

The fonctionnaires are part of the civil service: part of that is only employed under private law. The other part is one of the officials in the broader sense, the agents publics. Agents publics are involved in the implementation of a public service and are subject to public law; Disputes are resolved in the administrative courts. Only a part of these is fonctionnaire. This is merely a status legal name. A liability legal definition as in the German civil service law is replaced by the figure of faute de service in French law. The legal basis for the fonctionnaires is the statute général de la fonction publique.
