Hague Conference on Private International Law

The Hague Conference on Private International Law ( HCCH ) is a permanent institution with the mission to work for the progressive unification of the rules of private international law. Since the beginning of the 20th century a number of conventions (Convention ) was adopted by them. Important outcomes of the conference include:

  • The Convention abolishing the requirement of legalization for foreign public documents ( HLÜ, October 5, 1961)
  • The Convention concerning the powers of authorities and the law applicable to the protection of minors (October 5, 1961 Federal Law Gazette II 1971, 219)
  • The Convention on the recognition and enforcement of decisions (October 2, 1973, Federal Law Gazette II 1986, 826 )
  • The Convention on the Law Applicable to Maintenance Obligations (October 2, 1973, Federal Law Gazette II 1986, 837 )
  • The Convention on the Civil Aspects of International Child Abduction (October 25, 1980, Federal Law Gazette II 1190, 206)
  • The Convention on the Protection of Children and Cooperation in Respect of Intercountry Adoption (May 29, 1993, Federal Law Gazette II 2001, 1034)
  • The Convention on Jurisdiction, Applicable Law, Recognition, Enforcement and Cooperation in respect of Parental Responsibility and Measures for the Protection of Children (October 19, 1996, signed by Germany, Austria, Switzerland and ratified )
  • The Convention on the International Protection of Adults (which are not in a position due to an impairment or insufficiency of their personal abilities to protect their interests ) of 13 January 2000; Federal Law Gazette II 2007, 323
  • The Convention on the closure and the recognition of the validity of marriages (14 March 1978)
  • The Convention on the Taking of Evidence Abroad in Civil and Commercial Matters (18 March 1970)
  • The Convention on the Recognition of Divorces (1 June 1970)
  • The Convention on the law applicable to the matrimonial property law (14 March 1978)
  • The Convention on the Testamentary Dispositions form on the right (October 5, 1961 Federal Law Gazette II 1965, 1144 )
  • The Convention on Choice of Court Agreements (June 30, 2005)
  • The Convention on the international recovery of maintenance claims of children and other family members (27 November 2007) and the Protocol on the Law Applicable to Maintenance Obligations (27 November 2007)

The efforts of the Hague Conference on a Convention on the Recognition and Enforcement of Foreign Judgments in Civil and Commercial Matters, as it were, the international equivalent of the Brussels I Regulation, can currently be viewed as a failure. The result is simply the Convention on Choice of Court Agreements, for which a consensus could be reached.
