High Council of Justice (Albania)

The High Council of Justice (Albanian Këshilli i Larte i Drejtësisë, short KLD ) is a government agency in Albania, which proposes the judges in the courts of first instance and in the appellate courts to the President for appointment. In addition, he is responsible for other rights and obligations.

The election of judges is governed by the ninth section of the Albanian Constitution. Article 147 regulates the basic principles of work of the High Judicial Council. An Implementation Act of 17 May 2001 provides the details. The headquarters is located in the capital Tirana.

Members

The High Judicial Council is composed of twelve members who have a term of five years and meet at least once every two months.

Among its members are in addition to the President, who takes over as chairman, the chairman of the Supreme Court, the Minister of Justice, three Members of Parliament and nine judges of all levels, who are elected by the National Judicial Conference.

Duties and Powers

The High Council of Justice plays in the professions, the judge in the first instance and in the appellate courts a crucial role. She is responsible for the filling of vacancies by proposing the President-in candidates. Furthermore, the Council may take disciplinary action against judges, change the place of work of judges and transfer them.

The judges of the Constitutional Court and the Supreme Court are not alone proposed by the High Judicial Council, but approved by Parliament.
