Insular Cases

Under the title Insular Cases is combines several decisions of the U.S. Supreme Court from the early 20th century together. The cases focused mainly on a central issue of the presidential election in 1900 and the American Anti- Imperialist League, which is expressed in the following question: "Follow the Constitution of the flag? " ( "Does the Constitution follow the flag ?"). The Supreme Court ruled that full constitutional rights can not be automatically extended to all areas under American control.

1898 annexed the USA Hawaii. In the same year the Paris Peace ended the Spanish-American War, after which the United States came into the possession of Cuba, Puerto Rico, Guam and the Philippines. At this time there was a debate over the government in these new territories, there were no rules on this subject in the Constitution. With the Insular Cases, the Supreme Court provided the framework for the application of the version on these islands.

There is not an authorized list of cases. The term refers to at least some cases dating back to 1901, but sometimes later decisions are included.
