National emblem

Under a national emblem ( or territorial symbol ) is defined as the symbol to represent a state sovereignty, as it is practiced legally in the form of state and municipal authorities and institutions by the state, the member states and the municipalities.

Forms and functions of national emblem

An emblem is usually represented by banners, flags, crests, badges and official seal.

You identify and represent the corresponding state and its laws legitimized by public authority. You declare a rule that object or subject, to which they relate or on which they are mounted on the legal matter, the property or to the official or officials of each country.

Examples: Federal service flag, country flags Service, Iron Cross of the German Federal Armed Forces, Police Star.

Emblems on military aircraft hot Flugzeugkokarde ( rarely aircraft badge). They are usually held in the national colors of each country. In the English language they are called Roundel.

Abuse in individual countries

In Germany, the public denigration of emblems by § 90a Section 1 No. 2 of the Criminal Code are punishable with imprisonment of up to three years. Also the unauthorized use, malicious removal or abuse of an emblem is punishable or improper manner.

In Austria, the public denigration of emblems by § 248 para 2 of the Criminal Code are punishable with imprisonment of up to six months. Also the unauthorized use or misuse of the emblem is punishable.

In the U.S., however, the burning of the flag by the Supreme Court as protected freedom of speech has been repeatedly defended against criminalization of attempts by the U.S. Congress.
