Nexum

Nexum derived from nectere ( bind ), is a term derived from Roman law. It describes a schuldbegründendes business, which was normalized in the Twelve Tables.

In a Nexum the debtor also went through Manzipationsakt into the hands of the creditor. From this it could follow in case of insolvency enforcement custody. If no other compensation was reached, threatened the ultima ratio, namely the sale of the debtor into slavery (trans Tiberim ), as the final legal consequence.

The Nexum was no longer applied in the course of the late 4th century BC; future the demand justification only by stipulation was possible.
