A brief is a written statement of a party to the court or administrative during the administrative procedure.

Mostly applies a brief period.

Species

In court proceedings, a distinction between preparatory and determining pleadings:

  • Preparatory briefs are intended to simplify the hearing by many facts and the dispute points to be clarified in advance of the court hearing. This corresponds to the process maxim of concentration principle that a legal case should be done if possible in an oral hearing.
  • Determining briefs, however, directly affect the progress of a process. Examples which may be mentioned for the German civil pleadings that explain a discontinuance or a consent.
