Private copying levy

The lump-sum tax ( colloquially copyright levy ) denotes a statutory levy for the reproduction and making available publicly copyright goods and goods. Calculates she is as surcharge on the price of equipment or media for making or storing of reproductions ( § 54 German Copyright Act ) as a charge for the operation of such devices ( § 54c and § 53a of the German Copyright Act ) and for the public making available of protected goods ( § 52a and § 27 Section 2 of the Copyright Act ).

The flat tax replaces the payment every single service provided by a lump-sum compensation, but without the duplication, to legalize the providing or use of the goods in any case. Rather, it is a compensation for legal private copies and legal Zugänglichmachungen, illegal black copies are not compensated for it. In determining the tariff analyzing user behavior by collecting societies at regular intervals and used to calculate the amount of the fees.

The requesting the lump-sum amount with device manufacturers and importers will be performed by the Central Organisation for Private Copying Rights (short ZPÜ ). This distributes the royalty revenue to its shareholders (among GEMA, VG Wort and VG Bild-Kunst ) This, in turn, pour a portion of the revenue from their members, as they can be the author of the duplicated works.

History

The Federal Constitutional Court has already ruled in 1971 regarding the then blank tape levy that the lump-sum amount is admissible.
