Reduction in rank

Degradation is the colloquial name for a reduction of a person from their original rank within a hierarchy in the course of disciplinary proceedings, ie the opposite of a promotion. This occurs in the Military Disciplinary Code and in the civil service both in military affairs.

Like all disciplinary measures may be imposed on both these for breaches of internal rules official and generally accepted legal norms.

Germany

Military affairs

The Bundeswehr is to distinguish between a reduction in grade and rank reduction. The reduction in grade is governed by § 61 of the Military Disciplinary Code ( WDO ), and can be imposed only against soldiers, whose rank exists in two grade levels - for example, the lieutenant colonel in A14/A15 or the Colonel in A16/B3 - and higher after the level are paid. The " Degraded " thus retains his rank, but he gets less salary and is set on a low doped posts. In contrast, the rank reduction leads to the loss of the old service level. The rank reduction of one or more grades is permitted in accordance with § 62 WDO with officers to the lowest officer rank their careers. Officers can therefore be demoted to the rank of lieutenant. An exception is the medical officers, the only up to grade medical officer ( Captain ) can be reduced. Contrary to widespread rumors play the grade groups in the degradation of officers not matter, so that - with few exceptions - all officers can be demoted to lieutenant.

In non-commissioned officers who are career soldiers, a demotion to sergeant is possible; for all the other soldiers, there are no restrictions.

Both measures can only be imposed by a military court service and automatically have a three-year transport lock the consequence which can however be shortened by the court in exceptional cases two years.

Service level reductions are exceeded in severity only by the removal from service. ( early release )

Civil Service Law

In the civil service law is called the measure demotion. It refers to the particular grade level. If done to the lower grade level a different official name is - what is true in almost all cases - is to lead this. An official may be more than up to the entrance of his official career easier, medium, fine or higher service downgraded.

The demotion may be imposed by the Disciplinary Chamber of the Administrative Court and includes a five-year transportation lock. As a heavier action, there is only the distance from the civil service. ( early release )

Switzerland

The Swiss military criminal law is the degradation va in Article 35 of the Military Criminal Act of June 13, 1927 ( MStG SR 321.0 ) regulated.

United States of America

The Uniform Code of Military Justice allows the degradation over rank groups of time. An example is the degradation Frank Wuterichs. He was ( rank group commissioned officers with sword knot ) demoted from Staff Sergeant to Private ( rank group teams).
