Tom O'Higgins

Thomas " Tom" Francis O'Higgins, Jnr. (Irish Tomás Ó hUiginn; born July 23, 1916 in Cork, † July 23, 2003 in Dublin ) was an Irish Fine Gael politician, President of the Supreme Court ( Supreme Court ) and Judge at the European Court of Justice ( ECJ).

Biography

Tom O'Higgins came from the influential family of politicians O'Higgins. His father, Thomas F. O'Higgins was for many years senior deputy ministers and temporarily, his younger brother Michael O'Higgins was also Member of Parliament and Senator. In addition, he was the nephew of Kevin O'Higgins.

He initially studied law and then worked as a lawyer. His political career began in 1948 when he was first elected as a candidate of the Fine Gael in the Dáil Éireann. There he represented initially until 1969, the interests of the constituency Leix - Offaly (from 1961 called the constituency Laoighis - Offaly ) and finally last until 1973 for the constituency of Dublin South County.

On June 2, 1954 he was appointed Taoiseach John A. Costello as health minister in his cabinet. This he was a member until the end of Costello's term of office on 20 March 1957.

As before the presidential elections in 1966 the party leader of Fine Gael, James Dillon, renounced in his favor his candidacy against President Éamon de Valera, there was a small sensation, since O'Higgins with only 1 percent difference extremely narrowly lost against the incumbent.

In the presidential elections in 1973 O'Higgins joined again as the candidate of the Fine Gael. Since the current incumbent de Valera was not allowed to stand as a candidate, he entered this time against the former Deputy Prime Minister ( Tánaiste ) and Minister of Health Erskine Hamilton Childers as candidates of Fianna Fáil on. This time Tom O'Higgins was defeated, however, quite clear with 4 percent difference and about 48,000 fewer votes than Childers.

In 1973, he opted not to run again for the House of Commons. Instead, it was created in 1974 by President Childers as President ( Chief Justice ) of the Supreme Court, the highest judicial authority of Ireland, appointed. The Office of the Chief Justice he held until 1985. In this role, he was next to the chairman of the House ( Ceann Comhairle ), Seán Treacy, and the President of the Senate ( Cathaoirleach ), James Dooge, for twice during his tenure and that from 17 November (death of Erskine Hamilton Childers ) to December 19, 1974 and from November 22 (withdrawal of Cearbhall Ó Dálaigh ) to December 3, 1976 member of the so-called Presidential Commission ( Coimisiún na hUachtaránachta ), which in the case of premature departure of a president to hold office until a new President into office of the head of state leads. During his tenure as Chief Justice was, among others, in 1983 the judgment of the continuing illegality of homosexuality, which was later revoked, however, by the European Court of Human Rights ( ECHR).

Following his position as Chief Justice O'Higgins was 1985-1991 Judge at the European Court of Justice ( ECJ).
