Warehouse receipt

The Order warehouse receipt ( § 475, § 476 in connection with § 363 HGB ) is an order document that is issued by the storekeeper. It represented a commitment to publication of the stored goods to the authorized recipient. Unlike the names warehouse receipt for the name of the recipient of the Order warehouse receipt contains the words "or to order". This is generally a security and tradition paper in particular.

Legal components

The Order warehouse receipt is issued in the name and address of the depositor. It must also contain the name of the storekeeper and the place and date of entry or the issue of warehouse receipt. The stored goods must be named with the " common name " (possibly with dangerous goods are generally recognized under the dangerous goods regulation designation). Similarly, number, marks and numbers of packages or the quantity of the goods or the gross weight must be specified. Should there be a collective storage, this must also be noted.

Transmission

The transfer of the warehouse receipt, the right of disposal proceeds ( claim for ) items for storage on the (new) receiver (MRP paper). This is done with a transfer endorsement on the back ( endorsement ).

When transfer of ownership or lien can thus only the paper is passed, not the stored material. The advantage is that the warehouse receipt can thus be deposited with banks as collateral for loans and loans ( margin loan ).
