Christopher Besoldus

Christoph Besold (* September 22 1577 in Tübingen, † September 15, 1638 in Ingolstadt ) was a German jurist, and statesman scholar.

Life

Besold comes from a Lutheran family, came in 1630 to Catholicism. From 1591 Besold studied in Tübingen, first philosophy with the degree Magister, then studying law. 1598, he obtained his doctorate in law. He befriended in the study with Johannes Kepler. His younger brother, Johann George Besold, was also a lawyer in Tübingen and worked with him.

After working as a lawyer at the High Court, like his father, he became in 1610 professor of the Pandects at the University of Tübingen. 1630 he converts to Catholicism, makes this step but not until 1635 known after he had entered the service of the Catholic Austro- Württemberg government.

This change of faith was hotly debated and assessed differently today: Was Besold an optimist or he acted out of deep conviction, who sought the mysticism in the Catholic faith?

That it does not - only - was opportunism, thus it is clear that he was already looking in the study after mysticism, he stood near the Rosicrucians. His circle of friends was Johann Valentin Andreae.

1636 was Besold Professor of Codex Justinian and the Jus publicum, that of public law at the University of Ingolstadt.

Teaching

In addition to legal works Besold has also written historical, theological and national economic treatises.

Besold represents the doctrine of double sovereignty. The state arises from the Company by the general will of the individual members. In this he agrees with the popular sovereignty doctrine Johannes Althusius match. In addition, he also recognizes the maiestas personaliz, ie the transfer of sovereign sovereignty by God. After Besold can the Holy Roman Empire of either of the two principles clearly assigned, but has with the Emperor on the one hand and the estates of the empire on the other hand, both principles.
