Mallory now belonged to the House of Representatives on for two terms and was elected to the Senate of Ohio in 1998. One of his greatest achievements as a senator was in 2003 when the Parliament of Ohio ratified the 14th Amendment to the Constitution of the United States. However, this act was purely symbolic, since the Amendment was a valid part of the Constitution of the United States since July 28, 1868.

2005 Mallory was elected to succeed Charlie hatches mayor of Cincinnati and sworn in on 1 December 2005 as the 68th incumbent. It is thus for more than 70 years, the first mayor who not previously belonged to the City Council of Cincinnati.
