Cesare Battisti (born 1954)

Cesare Battisti ( born December 18, 1954) is a former member of the Proletari Armati per il Comunismo (PAC ), a militant left-wing group during the " Years of Lead " in Italy supported a violent revolution. Later Battisti, was active as a writer and has published 15 books.

After he was sentenced to 12 years in prison for membership in an armed group, Battisti fled to France, where protected him the Mitterrand doctrine. In absentia, he was sentenced to life imprisonment for four murders. As the Mitterrand doctrine was 2002 de facto revoked Battisti fled before transfers to Brazil.

March 18, 2007 arrested him Brazilian and French police forces in Rio de Janeiro. However, the Brazilian Justice Minister Tarso Genro granted him the status of a political refugee, what internationally mixed reactions provoked. On 5 February 2009 the European Parliament adopted a resolution which supports the Italian position and held a minute's silence in memory of Battisti's victims. On 18 November 2009 the Brazilian Constitutional Court declared the refugee status for illegal and allowed the extradition, but held just as firmly that the Brazilian Constitution, the President shall have the power to refuse extradition. Luiz Inácio Lula da Silva announced on December 31, 2010, his last day in office that he did not consent to the extradition. An application Battisti for release was rejected by the Supreme Court on January 6, 2011. However Selbiger decided on June 8, 2011 with 6 votes to 3 Battisti 's release, which took place immediately.
