Search (Cicero affair)

In September 2005, the prosecutor had Potsdam search the editorial offices of the magazine. The occasion was the article " The most dangerous man in the world " in the April issue, in which the journalist Bruno Schirra had the Jordanian terrorist Abu Musab al -Zarqawi and portrays this information quoted from confidential files of the Federal. It was a detailed evaluation report of 6 September 2004 with 125 pages and 392 footnotes. The German press criticized the raid as an attack on independent journalism, with parallels to the Spiegel affair pulled by 1962. Cicero 's chief editor Weimer and Schirra was accused of betrayal of secrets aid. FDP, the Greens and the PDS considered a parliamentary committee to do so. In October 2005, about a special session of the Bundestag Interior Committee was held, in which the politically responsible Schily should relate in non- public session to allegations of the prosecution position, the suspicion of secret treason initiated a search in Cicero was disproportionate.

On 21 and 22 November 2006, the First Senate of the Federal Constitutional Court was negotiating on the matter and ruled on 27 February 2007, searches have shown a significant interference with the freedom of the press. It was therefore unconstitutional ( Cicero judgment, Az: 1BvR 538/ 06). According to the judgment of mere suspicion is not enough that a journalist could have provided aid to the betrayal of secrets to search the premises of an editorial. For such an intervention in the freedom of the press would have rather clear evidence that a secret bearer would cause the release of proprietary information. Only then could be prosecuted for aiding and abetting a journalist. In addition, searches are not permitted if they only served to determine the identity of an informant; this was the case with Cicero. The decision of the Constitutional Court was seen by commentators as an important contribution to the protection of press freedom in Germany. From other commentators, however, criticism of this view was practiced.

The processes learned in the media wide attention as Cicero affair.
