Presidential Commission (Ireland)

The Presidential Commission (Irish Coimisiún na hUachtaránachta, " Commission of the Presidency" ) is a collective body of the Republic of Ireland and is regarded as the representative of the President in his absence. Venue is Aras an Uachtaráin.

Specifically, the Presidential Commission comprises the following persons:

Powers

The Commission may take over all duties and functions of the President of Ireland,

  • If the president can not perform his duties because of death, resignation or removal from office of a running process
  • In the period between the end of the term of office of the old and the inauguration of a new president
  • If the President is unable to exercise his duties temporarily, eg because of illness, visits abroad or other activities
  • When the president refuses to execute his office

Origin

The Commission was created by the Irish Constitution of 1937 and first appeared in the period from December 1937 ( the entry into force of the Constitution) and June 1938 ( inauguration of the first president) together. Since the beginning of time, no Irish Senate was elected, took over at that time the President of the Supreme Court (An Ard- Chúirt ) the seat of the Cathaoirleach.
