United Nations Security Council Resolution 1816

The Council Resolution 1816 of the UN Security Council is a UN resolution to combat piracy off the coast of Somalia, the Council unanimously adopted on 2 June 2008 at its 5902 session., The United Nations Security Council. The resolution called upon all States to cooperate with the Transitional Federal Government of Somalia (TFG ), were authorized to retract into the territory of Somalia or fly in and take all necessary measures in the framework of international law against piracy and armed robbery to the navigation.

The transitional government of Somalia as an internationally recognized representative accepted the resolution text. It was the first time that the Security Council in a manner such intervention under Chapter VII of the Charter of the United Nations in the territorial rights of a Member State. The move came because Somalia itself is not able to stop piracy in its territorial waters and the high seas from its waters out, and more recently the attacks of the pirates had risen sharply on merchant ships off the coast. The hijacking of ships for the purpose of ransom provide the Panel considers constitutes a hazard for crew, passengers and cargo and also hinder the supply of the population of Somalia by the World Food Programme (WFP ) food and other humanitarian supplies.

The provisions of the Convention have been explicitly recognized with the resolution, all States were invited to cooperate with the Somali government and the International Maritime Organization ( IMO). The vessels and military aircraft operating in the lake region states were obliged to be vigilant.

This resolution was introduced by France, the United States and Panama. The resolution is highly unusual in that it permits the application of international law in a way that engages the sovereignty of Somalia. France initially wanted that the resolution will be applied in other sea areas in which navigation is endangered by pirates, but Indonesia, Vietnam, Libya, South Africa and the People's Republic of China stressed at the meeting of the Security Council that the resolution is not set a precedent for other sea areas performing in the world, but refers only to the sea area of Somalia, where the local piracy endangers peace and security in the region.

The resolution is limited to six months and imposed on cooperating with the TFG States to report to the Security Council after three months on the implementation of measures report. It also requires the Secretary to report to the Security Council after five months on the implementation of the resolution and the situation in the waters off Somalia, so if Somalia wishes and the situation requires it, the extension of the measure may be decided by the Security Council.
