General

Legislature versus legislature

Compared to the term of the legislature, the notion of term is on. While the legislature referred to the effect of time of a Parliament, the term of the legislature also includes the times of the activities of other agencies or bodies such as of a municipal council or a works council.

Election date versus legislature

Clearly distinguished from the election date is the date of the commencement of an election or legislative period. The legislature is adopted by the period in which an elected parliament laws (Latin for " lex " majority " legit "). In general, the period shall begin only after an election, not just on election day, with the date of the first, so-called constituent meeting. They usually end with the convening of a new parliament or committee. Depending on the country or body but special rules apply.

Practical significance of the election period

About the mainly parliamentary documentation, the legislature has practical significance, for example, for the entry into force of some legislation. This can be controlled depending on the commencement of the election period.

For example, Article 7 of the Law amending the Lower Saxony state election law, the Lower Saxony deputies Act and the Minister of Law of 16 December 2004 is as follows ( Nds. GVBl S. 626. )

Articles 2 and 3 of this Mantel-/Artikelgesetzes respectively change the Nds. Deputies Law: Article 2 on 1 January 2005, Article 3, however, only the beginning of the 16th legislative term of Nds. Parliament, ie 26 February 2008.

Federal Republic of Germany

Since 1976, the legislature of the Bundestag begins with the first, namely inaugural meeting of the newly elected Parliament. The new parliament is convened by the former President of the Bundestag.
