New York gubernatorial election, 1792

The gubernatorial election in New York of 1792 took place in April 1792, the Governor and the Vice Governor of New York were elected.

Candidates

For the Democratic- Republican Party George Clinton came along with Pierre Van Cortlandt. For the Federalists John Jay went to Stephen Van Rensselaer with.

Result

John Jay received more votes than George Clinton, however, were due to technicalities, the votes of the County Otsego, Tioga and Clinton denied and not checked what George Clinton was a slight majority in the official result.

Under the Constitution of 1777 votes by a joint committee of the New York Legislature, six members of the Assembly, and five by the Senate, were tested. The votes auditors were David Gelston, Thomas Tillotson, Melancton Smith, Daniel Graham, Pierre Van Cortlandt, Jr., David McCarty, Jonathan N. Havens, Samuel Jones, Isaac Roosevelt, Leonard Gansevoort and Joshua Sands. The constitution states that the votes cast to the executive officers ( Secretary of State ) to be passed by the sheriff or his deputy. The ballots of Otsego County were handed over by Sheriff Smith, but whose term was expired and he held the office only up to the appointment of a successor. The ballot box from Clinton County was passed by a person without deputation, who received the urn by the local sheriff. The ballot box of Tioga County was passed by the Special Deputy Clerk, who was appointed by the sheriff.

The scrutinizing committee was of different opinion as to whether these ballots should count or not. This question was for the purpose of settlement to the U.S. senators from New York, Federalist Rufus King and Republican Aaron Burr, directed. King was of the opinion that all votes should be taken into account, while Burr was of the opinion that only the ballots of Clinton County should be allowed. Then rejected a majority in the tested Committee ( Gelston, Tillotson, Smith, Graham, Van Cortlandt, McCarty, Havens ) the ballots from all three counties and explained properly to George Clinton elected governor by a majority of 108 votes.

The minority ( Jones, Roosevelt, Gansevoort, Sands ) protested in writing. In Otsego County John Jay had a majority of about 400 votes and pulls you to the small majority of votes of Clinton in Tioga and Clinton counties from Jay would have won the election. Clinton was accused by the Federalists of usurpation and tested Committee had made a bipartisan decision against the wishes of the electorate.
